Coaching Services Agreement: This Is Luminosa

By proceeding with this booking and payment, you (the "Client") agree to the following terms and conditions with This is Luminosa (the "Coach"):

1. The Coaching Relationship

  • Nature of Coaching: Coaching is a partnership designed to facilitate the development of personal or professional goals and to create a strategy for achieving them.

  • Client Responsibility: The Client is solely responsible for their own physical, mental, and emotional well-being, as well as all decisions, choices, actions, and results arising from the coaching relationship.

  • Not Therapy: Coaching does not involve the diagnosis or treatment of mental disorders and is not a substitute for counseling, psychotherapy, or other mental health care.

  • Professional Disclosure: The Client agrees to inform the Coach if they are currently in any kind of therapy or under the care of a mental health professional.

2. Commitment & Professional Ethics

  • ICF Standards: The Coach agrees to adhere to the ethical standards established by the International Coach Federation (ICF).

  • Communication: To maximize the relationship, the Client agrees to communicate honestly, be open to feedback, and dedicate the necessary time and energy to the process.

3. Fees, Cancellations, and Term

  • Fees: By completing this payment, the Client agrees to the session fee indicated at the time of booking.

  • Cancellation Policy: The Client must provide at least 48 hours' notice to rearrange or cancel an appointment.

  • Late Cancellations: If less than 48 hours' notice is given, the Coach reserves the right to charge for that session or retain the session fee.

  • Termination: Either party may terminate the coaching relationship at any time, subject to the notice periods defined in this agreement.

4. Confidentiality

  • Standard of Care: The Coach will maintain the strictest levels of confidentiality regarding Client information as set forth in the ICF Code of Ethics.

  • Exceptions: Confidentiality does not apply if there is an imminent risk of danger to the Client or others, or if illegal activity is disclosed.

  • Legal Status: The Client acknowledges that the Coach-Client relationship is not a legally privileged relationship (like that of an attorney or physician).

5. GDPR & Data Protection

  • Data Collection: We collect and process your personal data (name, contact details, and session notes) only to provide coaching services and manage your booking.

  • Secure Storage: Your data is stored securely in a format of the Coach’s choice (digital or print) and will be retained for a period of no less than seven years to comply with professional standards.

  • Your Rights: You have the right to access, correct, or request the deletion of your personal data at any time, subject to legal and professional record-keeping requirements.

  • Third-Party Disclosure: We do not share your data with third parties without your written permission, except for ICF credentialing audits (limited to name and contact details) or as required by law.

6.. Liability and Dispute Resolution

  • Limited Liability: The Coach makes no guarantees or warranties regarding specific outcomes. In no event shall the Coach be liable for indirect or consequential damages.

  • Maximum Liability: The Coach’s entire liability shall be limited to the amount actually paid by the Client for the services rendered.

  • Dispute Resolution: Any disputes that cannot be resolved by mutual consent will first be attempted to be resolved through good-faith mediation.
